Who is garDsign?

garDsign, app.garDsign, tekenjetuin, gestaltedeinengarten, drawyourgarden and tekenmijntuin are trade names of garDsign Tools B.V. This privacy statement applies to the processing of personal data by garDsign Tools B.V. (KvK 88775127), hereinafter referred to as garDsign.

Processing your personal data

For garDsign, the protection of personal data is very important. We respect your privacy and always treat your data confidentially and according to the law.

What data are collected by us?

Of all website visitors: 

  • Technical data about your phone or computer 

From garDsign subscription holders profile data such as:

  • Name, zip code and city
  • Email address
  • Bank details

Of individuals participating in a course and/or workshop profile information such as:

  • Name, zip code and city
  • Email address
  • Bank details

What do we use your personal data for?

Your personal data will be processed by garDsign for the following purposes: 

  1. Performing the agreement(s) entered into with you;
  2. Keeping records, as well as other activities of internal management;
  3. calculating, recording and collecting amounts due, including placing claims in the hands of third parties; 
  4. To be able to interact with you and respond to questions you pose; 
  5. To inform you of new products and/or services and offers from garDsign; 
  6. the processing of your request for information;
  7. For being able to send digital newsletters sent to you by email;
  8. To improve garDsign's website and services; 
  9. For compliance with legal obligations, such as record-keeping and retention requirements;
  10. handling disputes and conducting audits.

What is the legal basis for processing?

The legal basis for the aforementioned purposes of processing lies in:

  • the consent given by you; 
  • taking pre-contractual measures at your request and/or implementing the contract concluded with you;
  • meeting legal obligations;  
  • the furtherance of legitimate interests of garDsign or a third party. 

For the purposes numbered above as 2 to 8 and 10, garDsign invokes the basis of legitimate interest. This legitimate interest consists of marketing purposes, internal management and historical and statistical research.

We want to provide you as a website visitor to garDsign with an optimal experience. We can only do this if we know what your wishes are. Therefore, we conduct a lot of research and analyze data on our website, for example.

Mandatory disclosure of personal data

When we ask you for personal data, we make it clear to you whether the provision is necessary or required by law. Moreover, we will tell you what the possible consequences are if you do not provide the data. The basic principle here is always that garDsign will not process more personal data than is strictly necessary.

Is personal data shared with third parties?

For optimal service, we share your personal data with our partners. These include partners who maintain our website and email system. And also with our sister company Yourgardenlife.

garDsign otherwise does not provide personal data to third parties who use the data for their own purposes. Unless you:

  • gave your prior consent to the disclosure.
  • garDsign is required by law to provide the data.

Does a transfer to countries outside the EU take place?

Your personal data is processed exclusively within the borders of the European Union.

Does automated decision-making and/or profiling take place?

garDsign does not use automated decision making and/or profiling.

For what period of time will personal data be kept?

Your data will never be kept longer than necessary or required by law. Based on our record keeping obligation, we are required to keep certain data for 7 years.

Optimal security of personal data

garDsign has obviously taken all necessary appropriate technical and organizational measures to secure your personal data against loss or unlawful use. On both an organizational and technical level, all data are treated confidentially.v

What are your rights in terms of personal data?

  • Right of inspection: You may inspect the personal data processed by garDsign.
  • Correction and deletion rights: you can have data changed or deleted. 
  • Right of Objection: You can always unsubscribe yourself from emailings, for example. Your objection to non-commercial use of your personal data, for example for our administration, we will resolve by mutual agreement.
  • Right to restriction: If you feel that we do not have the correct personal data about you, you have the right to have your data temporarily "frozen.
  • Right to data portability: You can have us transfer your data in a common machine format to another responsible person.
  • Withdrawal of consent: You always have the right to withdraw a consent once given. We will then cease processing immediately.

Changes?

This Privacy Statement is subject to change. These changes will be posted on the garDsign website.

Prior authorization for new purposes

garDsign may process your personal data for new purposes not yet listed in this Privacy Statement. In that case, we will contact you before using your data for these purposes. You will of course then be given the opportunity to refuse your participation.

Complaints?
